Intellectual Property Right Dispute
Securing and protecting one’s IPR requires immediate and prompt actions, and at ILS, we have on numerous occasions succeeded in securing and enforcing the IPR of our clients by filing an action for infringement of those rights before a District Court or High Court. Having a presence on a pan-India basis only gives our clients one-stop solutions in cases of protection against illegal abuse of their IPR rights. We have also advised and represented our clients in criminal prosecutions to safeguard and protect their IPR rights, specifically in respect of trademark and copyright.
We have closely assisted our client in seeking remedies available against infringement of different intellectual property rights that have a close resemblance to each other. For instance, in the case of infringement of a patent, design, copyright, or trademark, we obtained an injunction restraining the infringer from using the patent and also got damages on account of profits enjoyed by the infringer or losses caused to our client. In addition to the above remedies, the infringer has also made delivery of the infringing articles for erasure or destruction. Our intellectual property rights (IPR) team is well experienced in providing legal representation to our clients and working with other senior advocates and other law firms when warranted and in the best interest of the client.
Trademark/Design: At ILS, we understand that sovereignty over brand identifications is a basic and unalienable requirement for any corporate house, and we always believe and endeavour to strengthen the same and protect it from all sorts of passing off and arbitrary and illegal usage. In said endeavour, we provide a fulcrum of services, from registration of the mark, renewal of the mark, representation before the Registrar and the High Court, removal of the mark, application for rectification of the Trademark Register, appeals before the High Court, suit seeking permanent injunction with or without damages, suit for the destruction of the goods and articles bearing the infringed mark, criminal prosecution against the infringer, and other related litigation in the trademark-related matter.
